1. Program description
These Messaging Terms govern SMS (text) messages sent by or on behalf of Lazy Pay LLC ("LazyPay," "we," "us"). LazyPay operates two messaging programs:
a. LazyPay Payment Notifications (transactional)
Messages sent on behalf of a business that uses LazyPay (a "Merchant") to a customer of that business, concerning a payment the customer owes the Merchant. These include the initial payment request, follow-up payment reminders, and payment confirmations, each containing a secure link to view and pay the request. These messages are informational/transactional: they relate to an existing business relationship and a specific amount owed, and are sent only to phone numbers provided to LazyPay by the Merchant.
b. LazyPay Early Access & Product Updates (promotional/informational)
Messages sent by LazyPay to people who join our early-access waitlist and expressly opt in to texts — including launch notifications and occasional product updates about the LazyPay early-access program.
2. How consent is obtained (opt-in)
Payment Notifications
Merchants may only add customer phone numbers they are legally entitled to use for payment communications, and each Merchant represents that the customer has consented to be contacted at that number about amounts owed (see our Terms of Service, Section 5). The first message to any recipient identifies the Merchant the payment is owed to, and every recipient can opt out at any time (Section 3).
Early Access & Product Updates
Consent is collected on our website via an unchecked, optional checkbox presented with the waitlist form, accompanied by the following disclosure:
Checking the box is never required to join the waitlist by email, and consent to receive texts is not a condition of purchasing any good or service.
3. Opting out (STOP) and getting help (HELP)
- STOP: reply STOP to any LazyPay text message to cancel and stop receiving messages from that program. You will receive a single confirmation message of your opt-out, after which no further messages will be sent to your number unless you re-subscribe. The keywords STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT are also honored.
- START: reply START or UNSTOP to re-subscribe after opting out.
- HELP: reply HELP to any message for assistance, or contact us at support@lazypay.com. You may receive a message identifying LazyPay with support contact information.
Opting out of texts from one Merchant's payment notifications stops texts to your number sent through LazyPay; the Merchant may still contact you by other means about amounts you owe, and you may still receive emails if the Merchant uses email delivery.
4. Message frequency
- Payment Notifications: message frequency varies based on your payment activity with the Merchant — typically 1 initial request plus up to 5 reminder messages per invoice, spread over the invoice's life. Reminders stop automatically when the payment is completed or the request is canceled.
- Early Access & Product Updates: frequency varies; typically no more than 4 messages per month.
5. Fees and carrier disclosure
Message and data rates may apply according to your mobile plan. LazyPay does not charge recipients for messages. Messages are supported on major US carriers (including AT&T, T-Mobile, Verizon, and others); coverage on smaller or prepaid carriers may vary. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
6. Sample messages
Actual message content varies with the Merchant's name, amount, and link. Representative examples:
7. Privacy of mobile information
We treat mobile numbers and messaging consent with particular care:
- No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
- All categories of personal information described in our Privacy Policy exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties, except with our SMS delivery provider strictly as necessary to send the messages you have requested, or as required by law.
- Phone numbers collected for messaging are used only to deliver the messages described in these Terms.
See our Privacy Policy for full details on how we collect, use, and protect personal information.
8. Eligibility and general terms
- You must be the account holder of the mobile number provided, or have the account holder's permission, and be at least 18 years old.
- You agree to notify us promptly (and update your waitlist or Merchant records) if you change or deactivate your mobile number, so messages are not sent to a reassigned number.
- We may modify or discontinue a messaging program at any time. Material changes to these Messaging Terms will be posted on this page with an updated effective date.
- These Messaging Terms are part of, and subject to, our Terms of Service.
